Terms of Use for Botti.

This is a translation for your convenience. In case of doubt, the German version is authoritative.

1. Provider and scope

The provider of the Botti app and the Botti services (AI features, data retrieval, Botti Energy, handover bonus) is Coolblack GmbH, Südfeldwiese 14, 32107 Bad Salzuflen, Germany (info@coolblack.gmbh). These terms apply to all users of the app. Deviating or supplementary terms of individual users do not apply.

2. The service

Based on your description, Botti creates small HTML apps and runs them in a protected environment inside the app. Creation is performed by an AI model that we run through Microsoft Azure in the EU. By their nature, AI results are not always correct, complete or fit for a particular purpose; there is no entitlement to a specific result. Check the apps you create before relying on them — especially for calculations, reminders or health-related uses.

3. Botti Energy

AI features consume Botti Energy, an internal usage credit. The following applies:

• Botti Energy is not money, cannot be paid out and cannot be transferred; it serves solely to use the Botti services.
• Starting credit and bonuses may be adjusted in amount and conditions; energy already credited is unaffected.
• If the actual consumption of a request turns out higher than estimated, the balance may temporarily go negative; it is settled against the next credit.
• Future energy purchases are made exclusively through Apple's in-app purchase; Apple's terms apply in addition.

4. Your content and the apps you create

You are responsible for the descriptions you enter and for the apps you create or modify. You warrant that your content does not infringe third-party rights and does not violate applicable law. The rights of use in the apps you create are yours; Coolblack claims no rights to your content.

5. Private handover and import

You can hand created apps over privately — as a file (for example via AirDrop) or directly to a device near you — and import apps you receive. The following applies:

• Apps handed over are the content of the person who created them. Coolblack does not adopt this content as its own and does not review it for content. Apps are transferred exclusively between the devices involved; Coolblack does not store or distribute them.
• If something about a received app strikes you, you can pass it on to us via “Report app”. We follow up on every report and can block accounts that come to attention repeatedly.
• Botti checks imported apps technically: they run in an isolated environment without free internet or device access, every native feature requires your explicit permission, and undeclared access is blocked. This check is a technical safeguard, not a guarantee of content.
• Importing and running received apps is at your own responsibility. Do not import apps from sources you do not trust.
• Handover must not be used to distribute unlawful, deceptive or harmful content.
• The handover bonus is only credited for genuine first use by other people; obtaining the bonus by technical means is prohibited.

6. Prohibited use

In particular, it is prohibited to use Botti in order to

• create or distribute unlawful, fraudulent, harassing content or content harmful to minors,
• deceive third parties (for example apps that pose as other services or ask for credentials),
• circumvent the technical safeguards of the app or the Botti services,
• use the Botti services in an automated or abusive manner, or in a way that impairs their operation.

In case of violations, Coolblack may restrict or block access to the Botti services (AI, data retrieval, bonuses). Local features of the app remain unaffected.

7. Availability

The Botti services are operated with reasonable care; there is no entitlement to uninterrupted availability. Maintenance, further development, security incidents or outages at external providers may temporarily restrict the services. Apps already created remain usable locally on your device, as far as they do not use online tools.

8. Liability

Coolblack is liable without limitation in cases of intent and gross negligence, for damage arising from injury to life, body or health, and under the German Product Liability Act. In the event of a slightly negligent breach of material contractual obligations (obligations whose fulfilment makes use possible in the first place and on whose observance you may rely), liability is limited to the foreseeable damage typical for this type of contract. Liability is otherwise excluded.

Coolblack accepts no responsibility for the content that users create or hand over privately, nor for the results of the AI model. Claims relating to such content are directed at the person who created it.

9. Final provisions

The law of the Federal Republic of Germany applies; mandatory consumer protection provisions of your habitual residence remain unaffected. Coolblack may adjust these terms with effect for the future, for example in the case of new features or a changed legal situation; the current version is linked in the app and available on this page. Should individual provisions be invalid, the remainder stays in force.
